Don’t waitDeadlines in Ontario

The clock starts
the day it happens.

Ontario law sets strict deadlines. Miss one and a strong claim can be lost before it begins. These are three of the most common.*

  1. 7days

    Car accident benefits

Generally, tell your own insurer within 7 days of a car accident that you intend to apply for accident benefits.

  2. 1year

    Human rights at work

An application to the Human Rights Tribunal of Ontario is generally due within one year of the last incident.

  3. 2years

    Most civil claims

The basic limitation period in Ontario is two years from when you knew, or ought to have known, about the claim.

Frequently askedEleven questions
How long do I have to start a claim in Ontario?

For most civil claims, the basic limitation period is two years from the day you knew, or ought to have known, about the claim. Some situations have much shorter notice periods, such as accident benefits after a car crash or injuries on municipal property. Call as early as you can so no deadline is missed.

What should I do right after a car accident?

Get medical care first. Report the collision to police where required, take photos, collect names and insurance details, and tell your own insurer within 7 days that you intend to apply for accident benefits. Keep every receipt and medical record, and speak to a lawyer before giving a detailed statement to the other driver’s insurer.

I was fired. Should I sign the severance offer?

Not before getting advice. Many employees are entitled to more than the minimums in the Employment Standards Act, and signing a release usually ends your right to ask for more. Bring the termination letter and your employment contract to your consultation.

What is constructive dismissal?

It’s when an employer makes a major change to your job without your agreement, such as cutting pay, demoting you or making the workplace intolerable, so it is treated as if you were fired. Timing matters, so get advice quickly.

My insurer denied my claim. Is that the end?

Not necessarily. Denials can be challenged. We’ll review the policy wording, the reasons given and the evidence, and advise you on next steps, including the limitation periods that apply to insurance claims.

Can I challenge a loved one’s will?

Possibly. Common grounds include lack of mental capacity, undue influence, improper signing and suspicious circumstances around how the will was made. Estate disputes have strict time limits, so speak to a lawyer early.

Will my case go to court?

Most disputes settle before trial, often through negotiation or mediation. We prepare every file as if it may go to court, because that preparation is what leads to fair settlements.

How are legal fees handled?

It depends on the type of matter. Some personal injury cases in Ontario are handled on a contingency basis, where fees come from a share of what is recovered. We’ll explain the fee arrangement for your matter and set it out in writing before any work begins.

Can I get legal help in French?

Yes. Jacqueline Staley provides full legal services in both English and French. Services complets offerts en français.

What areas do you serve?

We serve clients across all of Ontario. Jacqueline has appeared in Ontario Superior Courts across the province.

What should I bring to my first meeting?

Anything related to your issue: letters, emails, contracts, insurance policies, denial letters, medical records, photos, and a short timeline of what happened. Don’t worry if you don’t have everything yet.
